In theory then, the Dolphins could be at risk of being sued for negligent misrepresentation? That is if a company even has the right to share mental health record with another...

I doubt they said anything at all about his mental condition so no, they didn't misrepresent anything

SO it is only negligent misrepresentation, if you are asked a specific question, like does Bess have any mental health issues and you say no..

More or less. Generally you don't have a duty to volunteer info but you can't provide misleading info.

But as I said, HIPAA only applies to records kept by or information know to the health providers themselves.

Nothing relating to Bess matters now, he was released from the Browns this past Friday.

His NFL career is likely over, the dude is sadly a basket case. His Rastafari obsession has taken him over the edge, the dude is quite frankly delusional either because of drugs or some serious mental issue or both. I wouldn't be surprised if he thinks he's the incarnate of Bob Marley.

Definitely a bummer to see this dude decline like this. He was a good player for this team during Sparano's tenure and played his heart out to earn a starting role for the slot. I even have his jersey. I really hope he gets his straightened out - I wish him the best.
